MARITIME AND SALES CONTRACTS - Disputes involving contract termination, force majeure, time bar, cancellation resulting in mitigation and damages.
MARINE INCIDENTS - One case involved the breaking in two of a mega container ship, evaluation of its structural strength, force majeure defense and marine insurance issues such as hull and machinery, cargo insurance, general average. Other cases involved navigation problems/grounding/collision/allision; safe port/ safe berth. Another case involved a fire on board of a vessel as a result of the heating up of an uncalcined petroleum coke cargo.
CHARTER PARTY DISPUTES - Cases involved the performance of time charter, voyage charter, contracts of affreightment, disputes relating to vessel characteristics, speed and consumption claims, laytime, demurrage.
CONTAINERS – Dispute involving the loss of containers overboard. Another dispute involved the failure to pick up containers at the discharge port and accruing damages.
BILLS OF LADING - Several cases involved disputes regarding the contamination of petrochemical cargoes discovered at discharge, water damage to cargoes such as soybeans or damage to refrigerated cargoes such as bananas.
FOB/C&F/CIF SALES CONTRACTS - Cases involved the performance of contract with respect to cargo specifications, delay; the cases related to cargoes of oil, petrochemicals, gas, coal, metals, sulfur, grain, oilseeds, bunkers.
PERSONAL INJURY - Served as arbitrator in several cases relating to personal injury sustained on a cruise vessel to be heard in Panama City, Panama. They all settled, however, right before a hearing was held and a final award was issued.
CONSTRUCTION - Arbitration concerned the delay by a construction company in the performance of its contract to widen the pier of a container terminal to accommodate larger container cranes. Another case related to the construction of a catamaran yacht. Still another case involved a more conventional yacht which developed problems emanating from faulty construction and maritime classification society’s inspection practices.
TELECOMMUNICATIONS - Case between two communication companies involving the laying of undersea telecommunication cables going from the U.S. to Europe. Arbitration concerned the leasing agreement of a SATELLITE TRANSPONDER; Breach of a leasing agreement on a MODEM.
LARGE INFRASTRUCTURE PROJECTS - Dispute relating to the transportation of pipes from China for use in a hydraulic plant n South America. Another case involved acting as sole evaluator and arbiter in determining the market for the supply of coal to a hydroelectric project in a South Pacific Island by special agreement by the parties.
